A wrongful death lawsuit has been filed by the family of a man who was recently trampled to death whilst working on a temporary basis at a Wal-Mart store in Long Island. The lawsuit has been filed against Wal-Mart as well as against the shopping centre and the company that was responsible for security at the shop.
Jdimytai Damour, who was aged thirty four, was trampled when two thousand customers rushed through the doors of the store last week to try and bag bargains at the Black Friday sales. He died from asphyxiation as a result of the incident. The lawsuit was filed in the New York State Supreme Court.
The family of the man said that the death could have been avoided, and Wal-Mart Stores, Inc., the shopping center Green Acres Mall, LLC, its owner Vornado Realty Trust and Securitas Services USA, Inc. have all been accused of negligence and recklessness.
The lawsuit said that the way in which the sale had been advertised and marketed was designed to draw in large crowds, and that the company and other defendants should have been prepared for the rush of customers on the day of the sale.
