Woman’s Lawsuit against Police Department and City Dismissed

A lawsuit that was filed against the police department in Waynesboro as well as the City of Waynesboro has been dismissed recently by a federal judge. The lawsuit was filed by an elderly black woman, who claimed in the lawsuit that excessive force was used against her.
According to seventy seven year old Ruby Gayle she was arrested in October of 2006 following a car crash by office Eric Fernandez. She claimed that the officer “pushed her down on her shoulder and jerked and twisted her arms behind her back to handcuff her.” She then decided to file an excessive force lawsuit.
While the lawsuit against the city and the chief has been dismissed there is still a case against Officer Fernandez, according to reports. The reports state that Gayle was prepared to go to the station although she would not sign an accident citation.
It is further claimed that whilst the officer was treating the woman roughly both Gayle and her daughter asked him to stop so that Gayle could make her way to the police cruiser, but that the officer continued to use excessive force.
