Widow Receives Award of Over Five Million

The widow of a man who died in 2003 following surgery at Jewish Hospital has been awarded over five million dollars in compensation. Norman Gene Carroll, the brother of former Gov. Julian Carroll, died in February of 2003 after surgery aimed at inserting a deep brain stimulating device.
The surgery was supposed to alleviate his Parkinson’s Disease but ended up taking his life. His widow, seventy three year old Retha Carroll, was awarded $5.1 million by a Jefferson Circuit Court jury. This included three and a half million dollars for her late husband’s pain and suffering, and also ninety six thousand dollars in medical expenses.
The attorney working on the case for Retha Carroll stated: “She is overjoyed that a jury finally made the health-care providers take responsibility. For five years … everybody said it was somebody else’s fault.”
The lawsuit was filed in 2004, and in it the man’s widow claimed that the doctors and nurses that were operating on Mr Carroll did not take appropriate action or stop surgery when Mr Carroll started struggling to breathe.
