Roy Tarpley, the former Dallas Mavericks player, has filed a federal lawsuit claiming that he was discriminated against by both the NBA and the team itself, accusing both of violating the Americans with Disabilities Act after he refused entry back into the league.
According to the lawsuit the defendants have violated the Act by refusing Tarpley entry back into the league after four years of clear drug tests. He was permanently banned from the NBA in 1995, and is a recovering drug and alcohol abuser according to reports.
Part of the lawsuit reads: “Tarpley is a qualified individual with a disability within the meaning of the ADA, in that he has a disability in the form of past drug and alcohol abuse, which substantially limits at least one of his major life activities.”
Tarpley accused the NBA of discrimination in 2006 with the Equal Employment Opportunity Commission, and the EEOC agreed with the former player. Tarpley stated: “I really didn’t want to do this, but they left me no choice. We tried to work things out. I applied for reinstatement and they just swept it under the rug.”
