A wrongful termination lawsuit that was filed against the city of Bay City could be heading to trial. The lawsuit was filed by the former Director of Public Works, John Kolessar, who claims that his employment was wrongfully terminated. The lawsuit was filed in Bay County Circuit Court in 2005.
According to recent reports there has been a settlement conference scheduled in relation to the lawsuit. However, if parties are not able to agree to a satisfactory settlement then the case may be headed to trial. The plaintiff in the lawsuit had worked for the city since 1996 until his termination in 2004.
The lawsuit states that the plaintiff had been told by his superiors that his employment was secure. However, he was then apparently contacted by his superiors while he was attending a conference, and was informed of the termination of his employment by phone.
The lawsuit also claims age discrimination, as a younger man was then assigned to the position. The lawsuit claims that this person lacked the knowledge and experience of the plaintiff. According to the lawsuit the plaintiff is owed around half a million dollars from the city in accrued and future benefits.
