A breast cancer patient has received compensation amounting to nine million dollars as a result of having medical coverage cancelled while she was undergoing treatment for the cancer. The case, against the California insurance giant Health Net Inc., has resulted in fifty two year old Patsy Bates receiving over nine million dollars in compensation.
After the insurance company cancelled her policy in 2004 Bates was left facing medical bills of nearly one hundred and thirty thousand dollars. She has now been awarded eight and a half million dollars in punitive damages and a further three quarters of a million for emotional distress.
The judge wrote: “It’s hard to imagine a situation more trying than the one Bates has had to endure. The rug was pulled out from underneath, and that occurred at a time when she is diagnosed with breast cancer, one of the leading causes of death for women.”
Bates said that she was delighted with the award and said she screamed when she found out how much she had been awarded by the judge. Her lawyer said that the award would make other insurance firms sit up and take notice, adding: “We are going to stop a put to this practice.”
