A man that has had his appeal of a CIA lawsuit rejected, with the Supreme Court making a decision to throw out the lawsuit and refuse to review it without any explanation to the plaintiff. The lawsuit was filed by Khaled el-Masri, who claims to have been kidnapped and tortured by CIA agents.
The German citizen claims to have been kidnapped in Macedonia in 2003 by CIA agents and he claims that after he was kidnapped he was held and tortured for months, by the CIA in Afghanistan. He added that in 2004 United States officials realized that he was not involved in terrorism and he was then released.
According to members of the Bush Administration, had the lawsuit been heard in court then state secrets would have been revealed and officials therefore put forward a motion to block the lawsuit. Lower courts took the side of the government, and this has now been backed by the Supreme Court’s decision to not review the case.
One civil liberties lawyer stated: “Well, we are very disappointed that the court decided not to take the case. We really felt that this was an excellent opportunity for the court to revisit the scope of the state secrets privilege.”
