Former Lacrosse Coach Can Go Ahead With Lawsuit

A former lacrosse coach from Duke University has been told by a superior court judge that he can pursue his lawsuit against the university, after lawyers from the University had tried to convince both the plaintiff and the judge that the university arbitration process had to first be followed before legal action could be taken.
However, Judge Howard Manning decided at the hearing at Durham County Superior Court that the plaintiff, Mike Pressler, did not have to follow the arbitration process that had formerly applied to him as an employee, and has allowed the lawsuit, which claims libel and slander, to go ahead.
According to the lawsuit Pressler lost his job in 2006, after an escort service dancer attended a team party and claimed that she was gang raped by team members. The allegations turned out to be untrue, and the university reached a confidential settlement with Pressler last year.
However, Pressler now claims that the vice president of public affairs and government relations at the university made slanderous and libellous remarks about him after the settlement had been reached.
