Band Sues Virgin Over Unauthorized Use Of Material

The alternative band, the Smashing Pumpkins, are suing their record label, Virgin, claiming that Virgin used some of the band’s music and their name in various deals with Pepsi and Amazon without first getting their permission.
Although the band has been signed to Virgin in the US for around seventeen years, bans members have claimed that the existing agreement that they have with the record label only covers the sale of digital downloads, and that Virgin therefore used the band’s image in these promotions without any authorization.
The lawsuit against Virgin was filed by the band in Los Angeles Superior Court earlier this week, claiming breach of contract. Members of the band stated that they had “worked hard for over two decades to accumulate a considerable amount of goodwill in the eyes of the public”.
The band further accused Virgin of compromising their artistic integrity through the unauthorized use of their images and material, and added that they would “never grant such authority to Virgin, or any other entity”.
